Terms of Service
Plain-English terms for using PhaseBid to manage electrical estimating, CRM, scheduling, proposals, billing, and AI-assisted draft workflows.
Operating Entity
PhaseBid is a software product operated by First Phase Electric LLC. References to "PhaseBid," "we," "us," or "our" refer to PhaseBid and/or First Phase Electric LLC as the operator of the platform.
Product and Brand
PhaseBid is the product and platform brand used for the estimating, CRM, proposal, and workflow software operated by First Phase Electric LLC.
Software Tool Only
PhaseBid is a software platform designed to assist electrical contractors with estimate drafting, proposal generation, customer management, job tracking, scheduling, project organization, file organization, pricebook workflows, and related business workflows. PhaseBid does not perform electrical contracting services, engineering services, code compliance reviews, permit reviews, inspections, estimating services, consulting services, legal services, tax services, accounting services, professional engineering stamp services, or professional review services.
Service Overview
PhaseBid provides software for electrical estimating, customer management, job tracking, scheduling, proposal preparation, file organization, templates, pricebook workflows, and AI-assisted estimate drafts. You agree to use the service only for lawful business purposes and only in a manner consistent with your own professional obligations, licensing requirements, customer agreements, and applicable laws.
Account and Workspace Data Responsibility
Users are responsible for the accuracy, legality, ownership, permissions, and backup of customer records, job records, estimates, uploaded files, photos, documents, logos, company information, pricing data, templates, proposal terms, and any other content entered into the platform. Users must ensure they have all rights, permissions, and customer authorizations needed to upload, store, process, and use that information in PhaseBid.
Account Responsibility
You are responsible for your login credentials, workspace users, customer records, job records, uploaded files, estimates, proposals, and activity under your account. Keep your account information accurate, protect access to your workspace, and promptly remove access for users who should no longer have it.
Subscription Billing
Paid subscriptions are billed through Stripe. By starting a paid plan, you authorize Stripe to charge the payment method connected to your account for recurring subscription fees, applicable taxes, and related charges. Plan features and prices may change with notice.
Plan Limits and Fair Use
Plan limits may apply to AI generations, customers, jobs, templates, files, storage, users, and other features. Unlimited AI usage is subject to fair use protections. AI-assisted estimate drafts are editable and must be reviewed and verified before use. Excessive automated usage, abuse, scraping, or activity that negatively impacts platform performance may be temporarily throttled, limited, suspended, or reviewed.
Cancellation Through Stripe Customer Portal
Subscription management, payment method updates, invoice access, and cancellation are handled through the Stripe Customer Portal from the PhaseBid Billing page. Cancellation timing and continued access depend on the subscription status and current billing period shown in Stripe and PhaseBid.
Refund Policy
Subscriptions are generally non-refundable once a billing period begins. If you believe there is a billing error or unusual circumstance, contact support and we will review the issue in good faith.
Contractor Responsibility
Users are solely responsible for independently verifying all information before relying on it, submitting it, sending it to a customer, purchasing materials, scheduling work, bidding a project, signing a contract, or performing work. This includes verifying scope of work, site conditions, existing conditions, labor requirements, material quantities, material selections, equipment specifications, pricing, markups, discounts, taxes, permit requirements, inspection requirements, utility requirements, NEC requirements, AHJ requirements, local code requirements, safety requirements, proposal language, contract language, customer proposal approval, and customer communications.
No Exclusive Reliance
Users agree not to rely exclusively on information generated, organized, suggested, calculated, displayed, stored, exported, or transmitted through PhaseBid when making business, estimating, purchasing, construction, bidding, scheduling, engineering, permitting, safety, or contracting decisions. PhaseBid is intended to assist contractor workflows and does not replace professional judgment.
AI Output Limitations
AI-assisted estimate drafts and AI-generated content may contain inaccuracies, omissions, incorrect assumptions, incomplete scope interpretation, incorrect quantities, incorrect labor assumptions, incorrect material assumptions, incorrect pricing assumptions, incorrect terminology, or unsuitable proposal language. AI-assisted outputs are editable drafts only and must be independently reviewed before use. AI outputs are not final bids, professional advice, engineering advice, code advice, permit advice, legal advice, tax advice, or accounting advice.
Pricing and Estimate Information
Material pricing, supplier pricing, benchmark pricing, labor pricing, estimate totals, fees, markups, taxes, discounts, and other pricing-related information may be incomplete, delayed, unavailable, outdated, inaccurate, regionally inappropriate, or unsuitable for a particular project. Users are responsible for verifying all pricing and financial information before relying on it, submitting a bid, purchasing materials, or sending a customer proposal.
Proposal and PDF Responsibility
Users are solely responsible for all estimates, proposals, PDFs, documents, contracts, customer communications, scope descriptions, assumptions, exclusions, pricing summaries, acceptance language, and other materials generated, modified, exported, stored, transmitted, or distributed through PhaseBid. Users are responsible for reviewing every proposal before sending it to a customer, including scope, exclusions, assumptions, terms, pricing, dates, customer information, job information, code language, permit language, and final proposal language.
Code, Permit, AHJ, and Safety Disclaimer
PhaseBid does not determine, verify, approve, or guarantee compliance with the NEC, local codes, AHJ requirements, utility requirements, permit requirements, inspection requirements, safety standards, project specifications, professional standards, or any other legal or technical requirement. Users are responsible for verifying pricing, material availability, labor needs, job conditions, applicable NEC requirements, local code rules, permits, inspections, utility requirements, AHJ requirements, and safety requirements before sending a proposal or performing work.
Geographic Scope
PhaseBid is designed primarily for electrical contractors operating within the United States. PhaseBid makes no representation that generated information, workflows, proposal language, estimating methodologies, terminology, pricing assumptions, code reminders, or project structures are suitable outside the United States. Users outside the United States are solely responsible for verifying all local laws, codes, regulations, standards, licensing requirements, tax rules, and estimating practices before using the platform.
No Guarantee of Estimate Accuracy
PhaseBid does not guarantee estimate accuracy, code compliance, permit approval, inspection approval, profitability, final project pricing, business outcomes, or that estimates, templates, pricebook data, AI drafts, proposal text, tax values, permit fees, discounts, totals, schedules, customer records, job records, file records, or scope notes are accurate, complete, profitable, code compliant, suitable, or appropriate for a specific job.
No Warranty
PhaseBid is provided "as is" and "as available." PhaseBid makes no warranties regarding accuracy, completeness, reliability, availability, uptime, security, profitability, suitability, code compliance, permit approval, inspection approval, pricing accuracy, labor accuracy, material accuracy, proposal accuracy, customer acceptance, contract outcomes, or business outcomes.
Third-Party Services
PhaseBid may rely on third-party services, including but not limited to Stripe for billing, Supabase for authentication, database, and storage, OpenAI or other AI providers for AI-assisted drafting, Resend, Zoho, or other email providers for support and transactional communications, hosting and infrastructure providers, and analytics, monitoring, security, or abuse-prevention providers. PhaseBid is not responsible for third-party service outages, errors, delays, data practices, terms, policies, pricing, availability, or performance.
Intellectual Property
The PhaseBid platform, including its software, source code, workflows, interfaces, proposal systems, graphics, branding, documentation, website content, templates, and related materials, is owned by or licensed to First Phase Electric LLC. Users may not copy, reproduce, reverse engineer, resell, redistribute, or commercially exploit any part of the platform except as expressly permitted through normal use of the service.
Limitation of Liability
To the maximum extent allowed by law, PhaseBid is not liable for lost profits, lost revenue, lost contracts, lost customers, lost business, bid errors, estimating errors, pricing errors, material shortages, material overages, labor overruns, change order disputes, scheduling conflicts, missed deadlines, permit issues, inspection failures, code violations, safety issues, construction defects, customer disputes, business interruption, inaccurate estimates, project losses, indirect damages, incidental damages, special damages, consequential damages, or other losses arising from or related to use of the service.
Termination
We may suspend or terminate access if you violate these terms, misuse the service, fail to pay required fees, create security risk, or create risk for the service or other users. You may stop using the service at any time.
